HOUSTON (AP) -Brian McNamee’s lawyers asked a federal judge on Tuesday for a two-week extension to Sept. 17 to respond to Roger Clemens’ attorneys, the latest maneuvering in their defamation suit.
Clemens sued his former trainer in January in Texas, and McNamee filed papers July 3 asking U.S. District Judge Keith P. Ellison to dismiss the case or move it to federal court in New York. Clemens’ lawyers responded Aug. 7, asking that McNamee’s motion be denied.
McNamee’s reply was due Wednesday, and the papers filed Tuesday said the extension request was unopposed.
The seven-time Cy Young Award winner sued McNamee for defamation after the trainer accused him in the Mitchell Report of using steroids and human growth hormone.
