HOUSTON (AP) -Attorneys for Roger Clemens’ former trainer asked a judge Wednesday to remove the pitcher’s attorney from the case.
Brian McNamee’s attorneys want Rusty Hardin removed because he also represented Clemens’ former teammate Andy Pettitte in the days leading up to the release of the Mitchell Report.
U.S. District Judge Keith Ellison did not immediately rule Wednesday.
If Hardin is not removed from the case, McNamee’s lawyers said there is a potential ethics problem if Clemens’ lawyers have to cross-examine Pettitte, who has testified Clemens informed him in 1999 that he used human growth hormone.
But Hardin said during Wednesday’s court hearing that there are no ethical problems in the case. Hardin said he would hire an independent attorney, if necessary, so that he would not have to question Pettitte.
McNamee has said he injected Clemens with steroids several times between 1998 and 2001. Clemens has repeatedly denied the allegations and filed a defamation lawsuit against McNamee.
