HARRISBURG, Pa. (AP) – A judge presiding over a civil lawsuit against Penn State and ex-assistant football coach Jerry Sandusky by an accuser who testified in Sandusky’s criminal child sex abuse trial has laid out his reasons for ruling the case should remain in Philadelphia.
Penn State is based in State College, 200 miles northwest. It has appealed Judge Angelo Foglietta’s decision to keep the lawsuit in Philadelphia.
The judge last week issued an opinion saying keeping the case in Philadelphia doesn’t present a burden to Penn State.
The plaintiff is called Victim 9 in court documents. He testified in 2012 that Sandusky violently attacked him in Sandusky’s home.
His lawsuit says he wouldn’t have been victimized if university officials had responded appropriately to complaints about Sandusky. It seeks compensatory damages.
Sandusky was convicted of abusing Victim 9 but says he’s innocent.
