NEW YORK (AP) -Brian McNamee’s lawyers plan to file a new motion to dismiss the defamation suit Roger Clemens filed against his former personal trainer.
Clemens filed suit in January, and McNamee’s lawyers first moved to dismiss the case in early March. When they responded to the motion on May 27, Clemens’ lawyers added a new claim of “intentional infliction of emotional distress” and two additional claims of defamation.
Richard Emery, one of McNamee’s lawyers, said McNamee will respond to Clemens’ amended suit with a new motion to dismiss. On June 3, U.S. District Judge Keith P. Ellison granted McNamee’s request for an extension of time and gave him until July 2 to answer Clemens’ amended complaint.
“We’re just working away,” Emery said Tuesday.
McNamee has accused Clemens of using steroids and human growth hormone, accusations the seven-time Cy Young Award winner has denied.
