OPELIKA, Ala. (AP) – Police say the man accused of poisoning landmark trees at Auburn’s Toomer’s Corner was assaulted shortly after leaving the courthouse.
Opelika police say Harvey Updyke Jr. told an officer he was attacked Wednesday afternoon when he stepped out of his car at a gas station. Capt. Allan Elkins says Updyke believes there was more than one person involved and that he was punched in the head, but didn’t see who did it.
Updyke was treated and released at East Alabama Medical Center with several small bruises and scratches.
Elkins says whoever is responsible could face misdemeanor charges, but that there were apparently no witnesses. The store did not have video surveillance.
Updyke is an Alabama fan.
