BIRMINGHAM, Ala. (AP) -An Alabama football booster who won $5 million in a slander lawsuit against the NCAA has given up collecting the money and will instead push for a new trial.
A lawyer for Ray Keller said Monday the Alabama timber dealer is now seeking a second trial.
A jury in Scottsboro awarded Keller $5 million in 2007. He accused the NCAA of slandering him in its investigation of Crimson Tide football in 2002.
A judge threw out the verdict and Keller appealed. But he has now dropped the appeal, and lawyer Don Word said Keller hopes for a second trial in Jackson County. Word said it’s possible jurors could award Keller more money in a retrial.
