TALLAHASSEE, Fla. (AP) -A judge has rejected the NCAA’s motion to dismiss a media lawsuit seeking access to documents on academic cheating at Florida State University.
Circuit Judge John C. Cooper on Thursday also turned down motions from the NCAA as well as The Associated Press and other media for summary judgments.
That means the case will go to a two-day final hearing starting Aug. 20.
The suit accuses the NCAA and Florida State of violating the state’s open records laws by denying public access to the documents on Florida State’s appeal of a plan to strip coaches and athletes of wins in 10 sports.
The NCAA contends it is not subject to the “sunshine” laws. Florida State has countersued, claiming the NCAA should release the records.
