FALMOUTH, Mass. (AP) -A Falmouth man accused of assaulting a New York tourist with a baseball bat because he thought he was a Yankees fan will not serve jail time if he stays out of trouble.
The case against 21-year-old Robert Correia was continued without a finding for two years, meaning charges will be dropped if he does not get into legal trouble in that time.
Correia was charged with assault and battery with a dangerous weapon after hitting a New York resident with an aluminum bat following a July 4 fireworks show.
William Nestor of Northport, N.Y., did not suffer serious injuries.
Nestor said he was struck after he asked people to stop taunting people with New York license plates. Correia claimed self defense.
The case received national attention because it involved the two baseball teams.
